It's the single most-asked question from our Costa Blanca clients: do I need town-hall permission to install a pergola or awning on my home? The answer depends on three factors: what you install, which municipality, and what type of building you're in. This guide walks through the typical situations and gives municipality-by-municipality guidance. Note that rules change: this is informational only and we always verify your specific case before starting.

Quick rule

Retractable roll-out awnings anchored to a facade: a prior notification is usually enough. Fixed ground-anchored pergolas, glazed enclosures, and any structure that increases the covered floor area: in most municipalities these require a minor-works licence. In apartment buildings or urbanisations with a comunidad de propietarios, you also almost always need the community's authorisation.

The basics: prior notification vs minor-works licence

In the Valencia region, Law 5/2014 (Territorial Planning) and Law 1/2019 distinguish two main procedures for minor residential works: prior notification (actos comunicados) and minor-works licence (actos sujetos a licencia).

Prior notification (comunicación previa)

A simplified procedure. You submit a responsible declaration at the town hall with property details, work description and budget. You can start the installation immediately (or after a short window depending on the local ordinance) unless the municipal technician flags a correction. Typically applies to retractable awnings, repairs and small facade work that doesn't affect structure.

Minor-works licence (licencia de obra menor)

A procedure with an express resolution from the town hall. Requires a technical brief and, depending on size, a project signed by a qualified technician. Applies to fixed ground-anchored pergolas (including bioclimatic), glazed enclosures that extend the covered area, significant canopies and any work that alters the building's volume. Resolution takes 1 to 3 months typically.

Torrevieja

Strict municipal ordinance on town-centre aesthetics. Awnings: prior notification using standard colour models. Fixed pergolas and enclosures: minor-works licence with technical project for structures over 9 m² or significant heights. Seafront communities usually require facade uniformity.

Comunidad de propietarios

If your home is in a building or urbanisation with a community, on top of the town-hall procedure you need the community's authorisation whenever the installation affects common elements (facade, a terrace that is a common element, the roof, etc.). The statutes and internal regulations usually set uniformity criteria (models, colours, materials). Simple-majority approval is common, but works that alter structure or significantly change aesthetics may require unanimity. We recommend presenting your proposal to the administrator or community president before signing a quote.

What if I've already installed without permission?

A common situation. Town halls generally allow after-the-fact regularisation provided the installation is legalisable under current ordinance. You pay the corresponding fee and, in some cases, a proportional fine. Installations that are not legalisable (excess built area, protected zones) may require removal. If in doubt, it's better to start the procedure before a municipal enforcement notice arrives.
